IMPORTANT INFORMATION
You should carefully read the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted these Terms and Conditions.
LICENSE
Our website grants you non-exclusive limited license to use the web templates and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license") issued by our company.
a) LIMITED USAGE GRANTED
You may use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template once more in order to make another project with the same design. If you are requiring an individual design for your business, it is recommended that a work for hire agreement is reached and paid for prior to work commencing. As all work is commercially licenced, in order to maintain warranty and trading terms, you are not authorized to resell, distibute, fork or claim exclusive rights over the copyrighted works of Absalom Media in your product.
b) MODIFICATIONS
You are not authorised to remove any copyright or licencing information regarding Absalom Media from the source code of any product purchased from this site. You are allowed to modify the footer code of a design to suit your site. You have the freedom to modify the work created for you by Absalom Media, however doing so will invalidate any warranty agreements in place. Support of a client modified design will be charged at standard market rates in order to maintain design stability.
c) UNAUTHORIZED USE
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company. This includes any training material supplied as part of implementation of a website.
d) ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Absalom Media.
e) OWNERSHIP
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Absalom Media, unless a negotiated work for hire agreement is reached and purchased. Our products are provided with a one week warranty post-delivery for fitness, merchantability and use, in accordance with fair trading and good consumer practices. Since we offer a preview of the finalised work throughout the design and development phases of your project prior to signoff and delivery, we envisage that you will not require this warranty unless a new browser or update of your content management system irrevocably breaks the existing work. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
OUR REFUND POLICY
Since Absalom Media is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing any article at our site. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date.
ANTIFRAUD CHECK
Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
TRADING TERMS
For complete web packages which comprise design and hosting, fifty percent deposit is require for the entire job is required up front. Delivery of design is done after all payments for job are done; we provide a design preview for all our clients. This allows you, our clients, adequate protection on the design and development of your corporate image.
For hosting packages, six months payment is required up front. Warranty for hardware installed by Absalom Media is handled by manufacturer.
DISPUTE RESOLUTION
Absalom Media seeks to maintain the best practise in customer service and support. In the event of a contractual dispute, we will endeavour to provide either a refund on the services rendered or third party impartial mediation in line with current Victorian fair trading laws.
Our company reserves the right to change or modify current Terms with no prior notice.
